By accessing or using https://eagleoverland.com (the “Site”), contacting us, submitting an enquiry, or booking a service, you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, please do not use the Site or our services.
Definitions
“Eagle Overland”, “we”, “us”, or “our” refers to Eagle Overland, a self-drive and overland safari brand operated under Africano Paraiso in Tanzania. “You” and “your” mean the person using the Site, submitting an enquiry, requesting a quotation, hiring a vehicle, or booking an expedition. “Services” include website use, consultation, trip design, route planning, vehicle hire, equipment hire, support services, and related logistics.
Use of the Site
- The Site is provided for information, legitimate trip planning, vehicle hire enquiries, and self-drive safari booking enquiries.
- You agree not to misuse the Site, interfere with its security, upload harmful code, scrape data unlawfully, or attempt unauthorized access.
- We aim to keep information accurate and current, but itineraries, equipment, pricing, availability, route conditions, and park rules remain subject to confirmation.
- The Site does not operate public comments or customer login accounts unless such functionality is added in the future.
Bookings & Payments
- Quotations: Quotations are provided for planning purposes and are not binding until written confirmation is issued and the required deposit is received.
- Deposit: A non-refundable deposit, as stated in your quote or invoice, is required to secure dates, vehicles, equipment, permits, accommodation, and related services.
- Balance: The remaining balance is due by the date stated on your invoice, commonly 30–60 days before departure. Late or missing payment may result in cancellation.
- Currency: Prices are quoted in USD unless otherwise stated. Bank charges, transfer fees, card fees, and foreign exchange costs are borne by you.
- Third-party costs: Park fees, permits, lodges, camps, flights, ferry services, activities, and other third-party services may require earlier payment and may have stricter non-refundable terms.
Pricing, Inclusions & Exclusions
Your quote, invoice, or written confirmation will specify what is included. Unless expressly included, prices typically exclude international flights, visas, vaccinations, personal travel insurance, fuel, personal expenses, traffic fines, optional activities, additional park fees, cross-border paperwork, and any services not listed as included.
We reserve the right to adjust prices due to changes beyond our control, including taxes, government charges, park fees, concession fees, fuel costs, exchange rates, supplier rate changes, or vehicle logistics. Any increase will be communicated promptly and applied fairly.
Changes & Cancellations
- Changes by you: We will assist with reasonable amendments where possible, subject to availability, supplier approval, route feasibility, and any additional costs.
- Cancellation by you: Written notice is required. Unless your invoice states otherwise, our cancellation schedule is:
• 61+ days before start: deposit forfeited.
• 31–60 days before start: 50% of total trip price.
• 0–30 days before start: 100% of total trip price. - Supplier charges: Third-party suppliers such as lodges, camps, airlines, permit offices, and activity providers may impose stricter cancellation terms, which apply in addition to our terms.
- Changes by us: We may alter routes, vehicles, accommodation, equipment, or arrangements due to safety, weather, road conditions, force majeure, supplier issues, mechanical issues, or operational requirements.
- Cancellation by us: If we cancel before departure for reasons within our control, you may choose a credit or refund of recoverable land-only services paid to us, excluding non-recoverable third-party charges. This is your sole remedy.
Travel Documents, Permits & Compliance
- You are responsible for valid passports, visas, driver’s licences, International Driving Permits where required, vaccinations, health requirements, and personal travel documentation.
- All authorized drivers must meet the age, licence, and documentation requirements stated in your confirmation or rental agreement.
- We may provide route, park, permit, and border guidance, but you remain responsible for complying with Tanzanian law, park regulations, road rules, customs requirements, and any applicable rules in transit or cross-border countries.
Vehicle Use, Insurance & Responsibility
- Vehicle handover: Vehicles are prepared for expedition use and handed over with a briefing. You must inspect the vehicle and report any issue immediately.
- Authorized drivers: Only named, approved, and licensed drivers may operate the vehicle.
- Route limits: Off-road driving is limited to permitted tracks and approved routes. Water crossings, dunes, restricted roads, and remote tracks may require prior approval.
- No night driving: Unless we expressly approve otherwise, night driving outside towns, between parks, or in remote areas is strongly prohibited for safety reasons.
- Vehicle care: You must operate the vehicle responsibly, avoid overloading, secure equipment, check tyres and fluid levels as instructed, use correct fuel, and protect the vehicle and accessories from theft or damage.
- Insurance: Vehicles include insurance subject to the terms, exclusions, limitations, and excess/deductible stated in your confirmation or rental agreement.
- Exclusions: Tyres, windscreens, underbody damage, roof damage, negligence, speeding, intoxication, unauthorized drivers, unauthorized routes, and prohibited use may be excluded from cover.
- Damage and recovery: You are responsible for costs not covered by insurance, including recovery, towing, replacement parts, equipment loss, and transport costs caused by misuse, negligence, or prohibited routes.
- Fines and violations: Traffic fines, park fines, penalties, and related administration costs are your responsibility.
Health, Safety & Assumption of Risk
Self-drive travel in Tanzania and East Africa may involve inherent risks, including wildlife encounters, remote areas, rough roads, dust, mud, river crossings, changing weather, limited communications, medical remoteness, and delays. By booking or using our services, you acknowledge these risks and agree to follow briefings, route instructions, park rules, and safety guidance.
You must hold comprehensive travel insurance covering medical treatment, emergency evacuation, cancellation, trip interruption, personal belongings, and vehicle excess where available.
Force Majeure
We are not liable for failure, delay, change, or cancellation caused by events beyond our reasonable control, including extreme weather, floods, road closures, natural disasters, epidemics, government action, park authority decisions, strikes, civil unrest, supplier failure, fuel shortages, or other events outside our control. We will make reasonable efforts to assist with alternatives where possible, but additional costs may be payable by you.
Intellectual Property, Links & Third-Party Services
- All Site content, including text, images, graphics, logos, design elements, and code, is owned by us or licensed to us unless otherwise stated.
- You may not reproduce, copy, distribute, modify, or create derivative works from our content without written consent.
- Third-party websites and services, including maps, lodges, camps, activities, flights, payment providers, and park authorities, are independent. We are not responsible for their content, policies, pricing, availability, or performance.
- Linking to our Site is permitted when fair, legal, non-misleading, and not presented as an endorsement without our permission.
Disclaimers, Limitation of Liability & Indemnity
- To the fullest extent permitted by law, the Site and Services are provided on an “as is” and “as available” basis without warranty of uninterrupted access, error-free operation, or complete accuracy of all information.
- Our liability for any claim arising from or connected with the Services shall not exceed the amount you paid to us for the affected portion of the service, excluding third-party charges we do not control.
- We are not liable for indirect, consequential, incidental, punitive, or special losses, including lost profits, missed connections, inconvenience, emotional distress, or loss of enjoyment, except where such exclusion is not permitted by law.
- You agree to indemnify and hold us harmless from claims, losses, damages, fines, penalties, and reasonable legal costs arising from your breach of these Terms, misuse of the vehicle, negligence, unauthorized use, or violation of laws and regulations.
- Nothing in these Terms excludes liability for death, personal injury caused by gross negligence, fraud, or any liability that cannot legally be excluded.
Governing Law & Jurisdiction
These Terms are governed by the laws of the United Republic of Tanzania. Any dispute arising from or connected with these Terms, the Site, or the Services shall be subject to the exclusive jurisdiction of the courts of Arusha, Tanzania, unless otherwise agreed in writing.

Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Material changes may also be highlighted on the Site. Continued use of the Site or Services after changes are posted means you accept the updated Terms.
